At PROBELTE we process your personal data for the following purposes and based on the following legitimate grounds:

To arrange for the dispatch of sales information, to carry out market research, surveys, marketing campaigns and the promotion of products and services on the legal basis of the consent that is requested from you, and the withdrawal of such consent shall not, where applicable, restrict the performance of the signed contract.

To prepare the company’s accounts on the legal basis of article 25 of the Commercial Code and to comply with billing obligations on the legal basis of Law 37/1992 of December 28 on Value Added Tax and RD [Royal Decree] 1624/1992 of December 29.

To comply with tax obligations on the legal basis of article 11.2 a) of Framework Law 15/1999 in conjunction with articles 93 et seq. of Law 58/2003 of December 17, the General Tax Law, and with security obligations on the legal basis of article 11.2 a) of Framework Law 15/1999 in conjunction with articles 71.1.c) and 298 of Royal Legislative Decree 8/2015 of October 30, approving the revised text of the General Law on Social Security.

To record images using video surveillance cameras on the legal basis of Law 23/1992 of July 30 on Private Security and the Private Security Regulation, approved by RD 2364/1994 of December 9.

To evaluate phytosanitary or seed tests carried out by professionals who provide additional support, on the legal basis of the proper maintenance and fulfillment of a business relationship.

Data processors outside the EU, under the protection of standard data protection clauses adopted by the European Commission.

4. RIGHTS

Anyone has the right to obtain confirmation as to whether or not we at PROBELTE are processing personal data concerning them.

Data subjects have the right to access their personal data, and to request the rectification of inaccurate data or, where appropriate, request the erasure of the data whenever, among other reasons, the data are no longer necessary for the purposes for which they were collected.

Where you have given your consent for any specific purpose, you have the right to withdraw this consent at any time, however this shall not affect the lawfulness of processing based on consent before its withdrawal.

In certain circumstances, data subjects may request the restriction of the processing of their data, in which case we shall only retain such data for the exercise or defense of claims.

In certain circumstances and on grounds relating to their particular situation, data subjects may object to the processing of their data. PROBELTE will cease processing the data, except where there are compelling legitimate grounds or for the exercise or defense of possible claims.

According to Data Protection legislation currently in force, both at the national level, falling within the scope of the recent entry into force of Framework Law 3/2018 of December 5 on the Protection of Personal Data and Guarantee of Digital Rights, and more specifically as legitimated by articles 13, 14, 15, 16, 17 and 18 of Chapter II of the same, the Exercise of Rights, as well as the European Data Protection Regulation 2016/679, you may exercise your rights of access, rectification, erasure, restriction of processing, portability and objection by sending an email to the following address: protecciondedatos@probelte.es or by ordinary mail to PROBELTE, S.A.U., C/.
